PRIVACY

Section A — Information We Collect

OpenMic Perform Pro, LLC (“OpenMic,” “we,” “our,” or “us”) collects certain categories of information in connection with an individual’s membership, use of OpenMic-operated platforms, participation in community features, and involvement in OpenMic-related activities. The categories of information collected may include the following:

 

A.1 Account and Registration Information

Information provided directly by a Member during enrollment, onboarding, or account maintenance, which may include:

  • Legal name and preferred name
     

  • Contact information (email address, phone number, mailing address)
     

  • Date of birth or age-related confirmations (where applicable)
     

  • Profile information submitted through membership forms or portals
     

  • Professional, creative, or experience-related information voluntarily provided
     

  • Account credentials or identifiers (excluding passwords, which are handled via secure methods)
     

Members are responsible for ensuring that registration information is accurate and kept current.

 

A.2 Communications and Member-Submitted Content

Information generated or shared through a Member’s participation in OpenMic platforms, community spaces, or communications, including:

  • Messages, posts, comments, and replies
     

  • Uploaded files, media, or other materials (“Content”)
     

  • Communications sent to or received from OpenMic, including emails, support inquiries, and administrative correspondence
     

  • Information voluntarily shared in discussions, forums, or collaborative spaces
     

Communications and Content may be processed, stored, and reviewed for platform operation, moderation, safety, compliance, and community management purposes.

 

A.3 Payment and Transaction Metadata

Payment-related information necessary to process membership fees or other charges, which may include:

  • Transaction identifiers
     

  • Payment status and timestamps
     

  • Subscription status and billing history
     

  • Limited payment metadata provided by third-party payment processors
     

OpenMic does not store full payment card numbers or sensitive financial account credentials. Payment processing is handled by third-party service providers in accordance with their own privacy and security practices.

 

A.4 Usage, Log, and Technical Data

Information collected automatically in connection with a Member’s access to and use of OpenMic platforms, which may include:

  • Log data (IP address, device type, browser type, operating system)
     

  • Access times, session duration, and interaction patterns
     

  • Platform usage metrics, diagnostics, and performance data
     

  • Analytics data used to understand feature usage, system performance, and member engagement
     

This information may be collected through cookies, logs, analytics tools, or similar technologies and is used to support platform functionality, security, and improvement.

 

A.5 Event and Participation Information

Information related to a Member’s voluntary participation in OpenMic events, productions, or activities, which may include:

  • Event registrations and attendance records
     

  • Role or participation details
     

  • Communications and logistical information related to events
     

  • Records of participation required for operational, safety, or compliance purposes
     

Participation in certain events or activities may be subject to additional notices, releases, or agreements, which govern the specific use of related information.

 

A.6 Future Tools and Technologies

OpenMic may collect and process the categories of information described above using tools, systems, and technologies that evolve over time, including automation, analytics, moderation, and AI-assisted tools, provided such collection and use remain consistent with this Privacy Policy, the Membership Agreement, and applicable law.

 

Section B — How We Use Information

OpenMic Perform Pro, LLC (“OpenMic,” “we,” “our,” or “us”) uses Member information for legitimate operational, administrative, and business purposes related to the membership, platform functionality, and OpenMic-related activities. Such use is limited to what is reasonably necessary, proportionate, and consistent with this Privacy Policy, the Membership Agreement, and applicable law.

 

B.1 Account Administration and Membership Management

Information is used to:

  • Create, authenticate, and manage Member accounts
     

  • Verify eligibility and maintain accurate membership records
     

  • Process enrollment, renewals, billing status, and account changes
     

  • Provide access to membership features, platforms, and resources
     

  • Respond to Member inquiries, requests, and support communications
     

 

B.2 Platform Operation, Maintenance, and Improvement

Information is used to:

  • Operate, host, maintain, and support OpenMic platforms and systems
     

  • Monitor system performance, reliability, and availability
     

  • Diagnose technical issues and improve functionality
     

  • Analyze usage trends to inform feature development and platform enhancements
     

This may include the use of analytics, automation, and technical monitoring tools.

 

B.3 Communications, Notices, and Member Engagement

Information is used to:

  • Deliver administrative notices, policy updates, billing communications, and service-related messages
     

  • Communicate regarding membership status, platform updates, events, or operational matters
     

  • Respond to Member-initiated communications
     

Members may opt out of non-essential marketing or promotional communications where applicable, but may continue to receive transactional or administrative messages necessary for membership operation.

 

B.4 Community Moderation, Safety, and Compliance

Information is used to:

  • Enforce Community Guidelines, Conduct & Etiquette standards, and other incorporated Policies
     

  • Monitor, review, and moderate Content and interactions for safety, professionalism, and compliance
     

  • Investigate reports, disputes, or violations
     

  • Protect the rights, safety, and integrity of Members, OpenMic personnel, and the community
     

Moderation and enforcement activities may involve manual review, automated systems, or AI-assisted tools, applied in a manner consistent with OpenMic’s policies and applicable law.

 

B.5 Business Operations and Legal Compliance

Information is used to:

  • Support internal business operations, analytics, and recordkeeping
     

  • Comply with legal obligations, lawful requests, and regulatory requirements
     

  • Prevent fraud, misuse, or unauthorized access
     

  • Establish, exercise, or defend legal claims
     

 

B.6 Innovation, Automation, and Evolving Tools

OpenMic may use Member information in connection with tools and technologies developed or adopted in the future, including automation, analytics, and AI-assisted systems, provided such use remains consistent with the purposes described in this Section, this Privacy Policy, the Membership Agreement, and applicable law.

 

B.7 No Sale of Member Personal Information

OpenMic does not sell Member personal information. Any use of information is limited to the purposes described above or as otherwise disclosed in this Privacy Policy.

 

Section C — How We Share Information

OpenMic Perform Pro, LLC (“OpenMic,” “we,” “our,” or “us”) does not sell Member personal information. Information is shared only as reasonably necessary to operate the membership, support OpenMic’s platforms and activities, comply with legal obligations, or protect the rights and safety of OpenMic and its Members, as described below.

 

C.1 Service Providers and Operational Partners

OpenMic may share Member information with third-party service providers and vendors that perform services on OpenMic’s behalf, which may include:

  • Hosting and infrastructure providers
     

  • Payment processors and billing platforms
     

  • Analytics, monitoring, and performance tools
     

  • Customer relationship management (CRM) and communication platforms
     

  • Security, fraud prevention, and access control services
     

Such service providers are authorized to access or process information only as necessary to perform services for OpenMic and in accordance with contractual obligations, confidentiality requirements, and applicable law.

 

C.2 Legal, Regulatory, and Compliance Purposes

OpenMic may disclose information as required or permitted by law, including:

  • To comply with applicable statutes, regulations, subpoenas, court orders, or lawful governmental requests
     

  • To respond to lawful requests from public authorities, including for national security or law enforcement purposes
     

  • To enforce the Membership Agreement or incorporated Policies
     

  • To protect the rights, property, safety, or security of OpenMic, its Members, or others
     

 

C.3 Business Transfers and Corporate Transactions

In connection with a merger, acquisition, reorganization, sale of assets, financing, dissolution, or similar business transaction, Member information may be disclosed, transferred, or assigned as part of the transaction, subject to applicable confidentiality obligations and legal requirements.

 

C.4 Aggregated and De-Identified Information

OpenMic may use and share aggregated, anonymized, or de-identified information that does not reasonably identify an individual Member for purposes such as analytics, reporting, research, platform improvement, or business planning.

 

C.5 Disclosures Directed or Authorized by the Member

OpenMic may share information at the direction of a Member or with the Member’s consent, including when a Member:

  • Participates in optional programs, events, or collaborations
     

  • Connects third-party tools or services to their account
     

  • Voluntarily shares information in community spaces or public-facing features
     

Members acknowledge that information shared voluntarily in public or semi-public areas of the platform may be visible to other Members or participants in accordance with platform settings and applicable Policies.

 

C.6 No Sale of Personal Information

OpenMic does not sell Member personal information and does not share personal information for cross-context behavioral advertising purposes.

 

Section D — Member Rights and Choices

OpenMic Perform Pro, LLC (“OpenMic,” “we,” “our,” or “us”) recognizes that Members may have certain rights and choices regarding their personal information, subject to applicable law, the nature of the membership, and OpenMic’s legitimate operational needs.

 

D.1 Access and Correction

Subject to applicable law, Members may request access to, or correction of, certain personal information maintained by OpenMic. Requests must be submitted through the contact method designated by OpenMic and may require verification of identity before fulfillment.

OpenMic may decline or limit requests where permitted by law, including where fulfillment would be impractical, would compromise security, privacy, or legal obligations, or would require disclosure of confidential, proprietary, or third-party information.

 

D.2 Deletion and Retention Requests

Where required by applicable law, Members may request deletion of certain personal information. OpenMic may retain information as reasonably necessary for:

  • Legal compliance and regulatory obligations
     

  • Dispute resolution, enforcement of agreements, or protection of legal rights
     

  • Security, fraud prevention, and system integrity
     

  • Recordkeeping, auditing, and legitimate business purposes
     

Deletion requests do not automatically result in deletion of Content, records, or information that OpenMic is entitled or required to retain under the Membership Agreement, incorporated Policies, or applicable law.

 

D.3 Opt-Out of Marketing Communications

Members may opt out of receiving non-essential marketing or promotional communications by following the unsubscribe instructions provided in such communications or through other designated account settings where available.

Opting out of marketing communications does not affect OpenMic’s ability to send transactional, administrative, or legally required communications related to membership, billing, policy updates, account status, or platform operation.

 

D.4 Account Preferences and Participation Choices

Members may choose whether to provide certain optional information, participate in community features, or engage in events or programs offered through OpenMic. Declining to provide optional information or participate in optional activities may limit access to certain features or opportunities but does not affect basic membership status unless otherwise stated.

 

D.5 Jurisdiction-Specific Rights

Depending on a Member’s place of residence, additional rights may apply under local data protection laws (such as rights to access, correction, deletion, or restriction of processing). Where such laws apply, OpenMic will honor applicable rights to the extent required by law.

Nothing in this Privacy Policy is intended to expand or limit rights beyond those required by applicable law.

 

D.6 Requests and Verification

To exercise applicable rights, Members must submit a request using the contact information or procedures specified by OpenMic. OpenMic may require reasonable verification of identity before processing a request and may deny requests that are fraudulent, excessive, or otherwise not permitted by law.

 

 

Section E — Data Security and Retention

OpenMic Perform Pro, LLC (“OpenMic,” “we,” “our,” or “us”) implements reasonable administrative, technical, and physical safeguards designed to protect Member information against unauthorized access, use, alteration, or disclosure, taking into account the nature of the information, the risks involved, and the size and complexity of OpenMic’s operations.

 

E.1 Data Security Measures

OpenMic’s security measures may include, as appropriate:

  • Access controls and authentication mechanisms
     

  • Use of secure hosting and infrastructure providers
     

  • Encryption and secure transmission practices where applicable
     

  • Monitoring, logging, and security review processes
     

  • Policies and procedures governing access to Member information
     

No system or method of transmission or storage can be guaranteed to be completely secure. Members acknowledge that participation in the membership and use of online platforms involves inherent security risks.

 

E.2 Limited Access and Internal Controls

Access to Member information is limited to OpenMic personnel, contractors, and service providers who have a legitimate business need to access such information for purposes consistent with this Privacy Policy, the Membership Agreement, and applicable law.

 

E.3 Data Retention

OpenMic retains Member information for as long as reasonably necessary to:

  • Provide and administer the membership
     

  • Maintain accurate business and financial records
     

  • Comply with legal, regulatory, and contractual obligations
     

  • Enforce the Membership Agreement and incorporated Policies
     

  • Resolve disputes and protect legal rights
     

  • Support security, fraud prevention, analytics, and legitimate business operations
     

Retention periods may vary depending on the type of information, the purpose for which it was collected, and applicable legal requirements.

 

E.4 Deletion, Anonymization, and Archiving

When Member information is no longer reasonably necessary for the purposes described above, OpenMic may delete, anonymize, or archive such information in accordance with applicable law, operational needs, and internal policies.

Deletion or anonymization may not occur immediately upon account termination or upon request where retention is required or permitted for legal, security, or business reasons.

 

E.5 Evolving Systems and Technologies

OpenMic’s data security and retention practices may evolve over time in response to changes in technology, operational needs, legal requirements, and industry standards. Any such changes will be implemented in a manner consistent with this Privacy Policy, the Membership Agreement, and applicable law.
